California Assemblywoman Lorena Gonzalez has introduced legislation that would make it clear that HOA landscaping can be drought resistant, regardless of Homeowners Association governing documents. The proposed legislation, identified as AB 2104, would clarify that an association’s governing documents include architectural or landscaping guidelines or policies and decisions by the board of directors applicable to a specific homeowner. This would clarify the existing prohibition contained in California Civil Code 4735 that is applicable to that is applicable to an association’s “governing documents.”
